SGS Summarizes US Congress Proposal to Ban the Procurement of Products Containing PFAS

 

SGS, the world’s leading testing, inspection and certification company, has published an overview of a proposal by the US Congress to ban the procurement of products containing perfluorooctanoic acid (PFOA) or perfluorooctane sulfonate (PFOS).

 

Introduced in July 2023, the proposed act – S.2283 ‘PFAS-Free Procurement Act of 2023’ – would prohibit executive agencies from entering into new procurement contracts for selected products if they contain either substance.

 

Products within the scope of the proposal:
- Non-stick cookware and cooking utensils
- Furniture, carpets and rugs treated with stain-resistant coatings

 

The act also directs executive agency heads to prioritize the procurement of products that do not contain any per- or polyfluoroalkyl substances (PFAS) at all.

 

The proposed effective date for the act is October 1, 2025.

SGS Summarizes California Prop 65 Settlement for BPA in Athletic Shirts

 

SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS summarizing a consent judgement relating to athletic shirts reached under California Proposition 65 (Prop 65).

 

In recent times, several brands, retailers and manufacturers of athletic clothing operating in California have received 60-day notices from the Californian Center for Environmental Health (CEH) for alleged Prop 65 violations in relation to bisphenol A (BPA). In the main, the affected products are made from polyester with some spandex.

 

BPA is associated with developmental issues, serious eye damage, respiratory irritation, skin allergies and reproductive harm.

 

The most recent settlement relates to athletic shirts, with a reformulation limit of no more than ten parts per billion (ppb) BPA. In addition, substitutes such as BPS are not permitted but a Prop 65 Warning can be used.

 

SGS published SafeGuardS to keep stakeholders informed about regulatory and market changes that could impact their business. SafeGuardS 167.23 provides an overview of the settlement, including details of how the CEH goes about making sure products conform to the requirements in Prop 65.

 

Stakeholders are advised to review SGS’s original SafeGuardS 167.23 for more information.

 

It should be noted, these agreements are only legally binding on those parties named in the settlement.

SGS Summarizes Brazilian Revision to Metal Cookware Legislation

 

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 168.23 covering Brazil’s amendment to its metal cookware ordinance.

 

The Brazil’s Ministry of Development, Industry, Commerce and Services and National Institute of Metrology, Quality and Technology issued an amendment to Ordinance 499/2021 on December 1, 2023. The ‘note’ under Sections 4.1.1.2 and 4.2.1.1 in Annex I are both updated, clarifying that:
- Ordinance 499/2021 is not limited to the metal materials specified in these sections
- Metal materials not specified in the ordinance must meet their respective technical standards and migration element requirements according to the Brazilian Health Regulatory Agency

 

Ordinance 499/2021 covers the technical regulations and conformity assessment requirements for metal cookware and includes provisions relating to, inter alia:
- Product scope
- Certification model options
- Specifications for conformity identification seals
- List of rules and standards for demonstrating compliance

 

SGS publishes SafeGuardS to keep stakeholders informed about regulatory and market changes that may impact their business. For more information, stakeholders are advised to review SGS’s original SafeGuardS 168.23.

 

These changes should be considered effective on December 1, 2023.
