The combined solution improves threat detection and response through risk-based prioritization and remediation that can be leveraged by any size organization or as part of a comprehensive managed services offering for managed security providers (MSPs) and managed service security providers (MSSPs).

EU Releases Technical Guidance on Leave On Hand Gels

On November 12, 2020, the European Commission released a technical guidance document that provides a non-exhaustive list of product claims that do not support the classification of leave-on hydro alcoholic hand gels as cosmetic products due to perception.

The document was published following the findings of the Sub-Group on Borderline Products on October 8, 2020, which were endorsed by the Working Group on Cosmetic Products via written procedure on October 23, 2020 and at its meeting on 12 November 2020.

The technical document complements the latest borderline manual and the guidance on the applicable legislation for leave-on hand cleaners and hand disinfectants.

Labeling elements that would not support a main cosmetic function of leave-on hydro alcoholic hand gels (not to be used on cosmetic products):

Claims:

  • Antibacterial, antimicrobial, antiviral, virucide, antifungal (and their attributes, such as ‘antiviral properties’, ‘antibacterial ingredients’, ‘inhibits bacterial growth’)
  • Disinfecting, disinfectant, disinfection, sanitizer, sanitizing
  • Antiseptic
  • Kills X% bacteria/viruses/microbes
  • Decontaminating
  • Formulation recommended by the World Health Organisation (WHO)
  • Anti-COVID-19, anti-coronavirus, anti-SARS

References or allusions to:

  • Infection, pandemic, diseases

Operators in California Reminded of Prop 65 Settlement Agreements

SGS is advising companies operating in California, USA, to stay informed on settlement agreements being made in relation to a variety of substances under California Proposition 65 (Prop 65).

Settle agreements exist between two parties and are not legally binding on businesses not named within the settlement. However, it is advisable for companies operating in California to use them as a guide to avoid future legal problems.

Settlement agreements involve a variety of consumer products and the substances:

  • Lead and its compounds
  • Phthalates:
    1. Butyl benzyl phthalate (BBP)
    2. Di-n-butyl phthalate (DBP)
    3. Di-n-hexyl phthalate (DnHP)
    4. Di(2-ethylhexyl) phthalate (DEHP)

    6. Diisononyl phthalate (DINP)

There have also been several settlement agreements covering only the phthalates DINP and DEHP.

Consumer products covered in these settlement agreements include:

  • Phthalates (various):
    1. Beauty accessories made with vinyl components
    2. Car mounts with suction cup
    3. PVC air hose
  • Lead and its compounds:
    1. Brass products – mailboxes, hose repair menders, musical mouthpieces
    2. Diving weights
    3. Handheld luggage with PVC handgrips
  • DINP (only):
    1. Boarding pass holders
    2. Circular knitting needles
    3. Watch bands
  • DEHP (only):
    1. Blenders
    2. Life vests
    3. Pet raincoats

The variety of consumer products included in these settlement agreements demonstrates how vigilant manufacturers and suppliers operating in California must remain.

Prop 65, or the ‘Safe Drinking Water and Toxic Enforcement Act of 1986’, is a unique piece of legislation passed in November 1986. It requires the state to maintain a list of chemicals (Prop 65 List) known to cause cancer, birth defects and/or reproductive harm. Unless exempted, businesses operating in California must provide ‘a clear and reasonable warning’ (Prop 65 Warning) before knowingly and intentionally exposing anyone to a substance on the Prop 65 List, which now contains around 900 chemicals. Companies have twelve months to comply with this requirement once a substance is included in the Prop 65 List.
