Geneva (August 26, 2025) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 121.25, focusing on the European Union’s (EU) revision of its Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) Annex XVII list of carcinogenic, mutagenic or reprotoxic (CMR) category 1A or 1B substances.


The revisions prohibit the use of these substances in certain conditions and concentrations. Key highlights of the changes include:
- Adding five entries to Appendix 2 (Category 1B carcinogenic substances), including the flame retardant tetrabromobisphenol A (TBBPA)
- Including one substance in Appendix 4 (Category 1B mutagenic)
- Introducing 12 substances to Appendix 6 (Category 1B reprotoxic), including bisphenol AF (BPAF) and two dibutyltin compounds

 

These amendments will apply from September 1, 2025. The exemption of cumene, when present as a substance on its own or as a constituent of other substances in kerosene or gasoline aviation fuel under certain conditions will be effective from 31 August 2025.

Geneva (August 21, 2025) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 119.25, summarizing North Carolina’s ban on di(2-ethylhexyl) phthalate (DEHP) in intravenous (IV) bags and tubing.


SB 600 (session law 2025-60) was signed on July 3, 2025, regulating DEHP in IV solution containers and tubing. This amendment adds Article 19C, DEHP Hazard Management, to Chapter 130A of North Carolina’s General Statutes on public health. Stakeholders should be aware, California has also regulated DEHP in IV bags and tubing.

DEHP is commonly used in medical devices as a plasticizer to increase flexibility.

The new law includes the following definitions:
- ‘IV solution container’ means a container used to house medicine, fluid or nutrition therapy that is intravenously delivered to a patient in a hospital, outpatient facility or other healthcare facility
- ‘IV tubing’ means tubing used to intravenously administer fluids, medication or nutrients directly to an adult, child or infant
- ‘Ortho-phthalate’ means a class of chemicals that are esters of ortho-phthalic acid, including all the chemicals listed in SafeGuardS 119.25

SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 118.25, reporting on a decision by the Court of Justice of the European Union (CJEU) that upholds the annulment of titanium dioxide (TiO₂) in powder form containing 1% or more of particles with an aerodynamic diameter less than or equal to 10 micrometers as a category 2 carcinogenic substance by inhalation.

TiO₂ is commonly found in many consumer goods, including food additives, food contact materials, sunscreen, coatings, adhesives, floor coverings, paints, paper, plastics, rubber, printing inks, roofing materials and toys. An amendment to Regulation (EC) No. 1272/2008 on the Classification, Labeling and Packaging of Substances and Mixtures (CLP Regulation) was published in 2020 by the EU, classifying TiO₂ in the specified forms as a carcinogenic substance.

This ruling was challenged in the EU General Court and subsequently annulled. On August 1, 2025, the CJEU upheld the annulment, dismissing appeals from the European Commission and France, noting that a manifest error had been made in assessing the reliability and acceptability of the study underpinning the classification, which led to the incorrect application of the classification criteria.
