WTO Circulates Proposed Changes to EU CLP Regulation

The European Union (EU) has informed the World Trade Organization (WTO) that it intends to revise Regulation (EC) 1272/2008 on Classification, Labeling and Packaging of Substances and Mixtures (CLP Regulation).

Among the proposed changes:

  • 39 entries added to Table 3 in Part 3 of Annex VI to the CLP Regulation ‘List of Harmonized Classification and Labeling of Hazardous Substances’ (Table 3). This includes bisphenol S (BPS) as a reprotoxic 1b substance
  • 17 entries in ‘Table 3’ replaced – including new classification and labeling information for bisphenol A (BPA)
  • One entry deleted from ‘Table 3’ – 1,5-naphthylene diisocyanate

BPS is an analogue of BPA and has increasingly been used as an alternative in a variety of applications – e.g., in curtains, flooring, furniture, leather, paper, cardboard and toys.

The WTO circulated this information on August 2, 2021. According to the notification, this draft regulation is proposed to be adopted in Q4 of 2021, with entry into force twenty days after it is published in the Official Journal of the EU (OJEU). It will then become effective 18 months later (possibly mid-2023).

Stakeholders should be aware they can begin conforming to the new requirements once it has entered into force.

China Introduces National Standard for Customer Experience in Textile Products

The Standardization Administration of China has released a new national standard – GB/T 40270-2021 ‘Textiles-General technical requirements based on consumer experience’.  

Product standards have traditionally been constructed from the perspective of product processes and technical levels; they give no consideration to the consumer experience.

GB/T 40270-2021 introduces an assessment index system based on the subjective perceptions of the consumers, i.e., visual, tactile and olfactory. It applies to end-use textile products, such as clothing and household textiles. The aim is to make enterprises pay closer attention to consumer demands. This will lead to the products that give better customer satisfaction.

Among the technical points in the standard are:  

  • General safety – textile products must conform to the requirements of GB 18401 or GB  31701 (products for infants and children)
  • Quality requirements – textile products must conform claimed related product standard
  • Visual perception (characteristics) – textile products include fiber shedding degree, pilling, resistance to pile loop extraction, force to rupture pocket seams, seam slippage of pocket seams, bursting strength of hosiery toe, colorfastness to washing (staining), colorfastness to light yellowing, shedding of glitter and appearance after laundering or dry-cleaning. Each testing item has its corresponding applicable products or specific parts of product
  • Tactile perception (characteristics) – textile products include prickle, water-vapor transmission rate, tactile sense for permanent label (including brand), tactile sense for zipper, tactile sense for touch and close fasteners, length for floats, slip resistance for hosiery. Each testing item has its corresponding applicable products or specific parts of product
  • Olfactory perception (characteristics) – textile products shall have no pungent smell

 

Stakeholders are reminded that this standard will come into effect on December 1, 2021.

EU Launches Enforcement Plan for Illegal Food Contact Materials Containing Bamboo Powder

Following a ban by several European Union (EU) Member States on food contact bamboo-melamine plastics, the European Commission has published the “EU enforcement action on food contact materials (FCM) made of bamboo ‘powder’.”

Importers of FCM made with bamboo powder have been required to submit an authorization dossier according to Regulation (EC) 1935/2004, the Food Contact Framework Regulation. The recent announcement stresses that food contact plastics can only be manufactured or imported into the EU if they have been produced using thoroughly assessed substances, such as additives, monomers and polymers, that are in accordance with Article 5 of Regulation (EU) 10/2011 (Union list, Annex I). FCM containing bamboo and other plant-based additives are not on this list and are therefore not authorized as legal.

Despite this, authorities are aware that several such products are still being made available. Between 2019 and March 2021, most RASFF (Rapid Alert System for Food and Feed) notifications for FCM containing bamboo fibers related to the unauthorized use of bamboo additives as a filler. Alongside this, many products are mislabelled as being made of 100% bamboo.

To respond to this, stakeholders, including the EC, Member States and the EU Food Fraud Network, agreed to launch an enforcement action plan in May 2021. The aim of this is to:

  • Ensure non-compliant products are rejected at borders
  • Incorrectly declared plastic product tax duties are recovered
  • Businesses are reminded about the illegality of these products, including support via e-platforms
  • Consumers are made aware of health and other issues

The EC has stated it will assist EU Member States in ensuring these products are no longer placed on the EU market.
