BTI Launches Banking and Commercial Real Estate Division

Hanover, MA, December 10, 2020 -- Brookline Transportation, Inc. (BTI), a Mayflower Van Lines agent specializing in commercial, lab, medical, science and residential moves, recently started a banking and commercial real estate division to its arsenal of commercial moving offerings. The new division will have staff and resources specific to those two industries.

“The reality of the pandemic has put some new realities before banks and commercial real estate professionals. Banks will most likely find themselves in the unenviable position on foreclosing on businesses, with commercial real estate facing the same with tenants,” said George Rohlfing, owner of the family-owned and operated BTI. “Commercial real estate professionals will also be faced with tenants who will either need to retrofit their existing space or downsize to a smaller space as more workers work from home.”

SGS Warns Californian Businesses About Recent Prop 65 60 Day Notices on Electronic Device Cases

SGS warns Californian businesses about thirteen California Proposition 65 (Prop 65) 60-day notices of violation that have been issued against manufacturers and suppliers of electronic device cases. The 60-day notices of violation relate to a failure to provide a ‘clear and reasonable warning’ about possible consumer exposure to Bisphenol A (BPA).

 

A 60-day notice of violation is a legal document that is served to a business that has allegedly violated the warning requirements in Prop 65. The thirteen 60-day notice of violation issued in October 2020 relate to a wide variety of products, including:

  • Mobile/cell phone cases
  • Earbud cases
  • Tablet cases
  • Notebook computer cases
  • Game console cases

Prop 65, or the ‘Safe Drinking Water and Toxic Enforcement Act of 1986’, is a unique piece of legislation passed in November 1986. It requires the state to maintain a list of chemicals (Prop 65 List) known to cause cancer, birth defects and/or reproductive harm. Unless exempted, businesses operating in California must provide ‘a clear and reasonable warning’ (Prop 65 Warning) before knowingly and intentionally exposing anyone to a substance on the Prop 65 List, which now contains around 900 chemicals. Companies have twelve months to comply with this requirement once a substance is included in the Prop 65 List.

BPA is a chemical known to cause female reproductive toxicity. It has been included on the Prop 65 List since May 2015 and, since May 2016, it has been the cause of multiple settlement agreements involving a wide variety of consumer products – thermal paper, food contact materials and articles, cell phone cases, etc. The agreements bind only the named parties to a reformulation of no more than 3 ppm for BPA, with a warning as an alternative.

When a business is issued with a Prop 65 60-day notice of violation, it normally results in a settlement negotiation between the two parties. This is not legally binding on businesses not named in the settlement but can act as a guide to help them avoid future legal problems.

COVID19 Products Regulatory Guidance Released by US CPSC

The U.S. Consumer Protection Safety Commission (CPSC) has released guidance to help industry stakeholders understand the current regulatory requirements for products that are in high demand because of the COVID-19 pandemic.

The current health crisis means a wide range of products are not only in high demand but are also being consumed beyond their typical usage. Product types included in the guidance include:

  • Face coverings
  • Face shields
  • Gowns
  • Gloves
  • Disinfectants and cleaning products  

The document covers regulatory requirements relating to flammability – the CPSC classifies face coverings, gowns and gloves as “articles of wearing apparel” and so they must comply with the requirements in the ‘Flammable Fabrics Act’. SGS lists the exemptions in SafeGuard 171/20.

It also covers the requirements relating to children’s products (12 and under) – face coverings, gowns and gloves must also comply with the labeling, testing and certification requirements of the Consumer Product Safety Act (CPSA). They must meet the following requirements:

  • Bear permanent tracking information
  • Total lead content limits (unless material exempted by 16 CFR 1500.91(d)(7)(i)
  • Lead in paint/similar surface coating limits

For face shields:

  • Non-medical use – subject to CPSC requirements
  • Children’s product – CPSIA requirements
  • Medical use – under the jurisdiction of the U.S. FDA

Finally, for disinfectant and cleaning products, the guidance notes that these come under a variety of agency jurisdictions, depending on the product. In addition, certain household products must have child-safe packaging, as per the Poison Prevention Packaging Act (PPPA).
