Maine Finalizes PFAS Product Rules

Geneva (June 11, 2025) – SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 075.25, summarizing the Maine Department of Environmental Protection’s (DEP) final regulation implementing its law on ‘Products Containing PFAS’. These rules, which took effect on May 6, 2025, set out restrictions, notification procedures and conditions for currently unavoidable use (CUU) of PFAS in consumer products.


Building on legislation enacted in July 2021 and amended in 2023 and 2024, the regulation applies to all new and unused products containing intentionally added PFAS, unless exempt. It mandates detailed notifications from manufacturers with over 100 employees and establishes a phased prohibition on the sale of such products starting January 1, 2032, unless a valid CUU determination is granted.

- Clear definitions of product scope and exemptions, including packaging and certain consumer goods
- Notification processes requiring detailed information and fees, with specific deadlines for submission
- Procedures for requesting CUU, including submission timelines and requirements
